1. Introduction

Elite AUS Migration Education Consultancy Pty Ltd (ABN 16 626 829 721) (“Elite AUS”, “we”, “us”, “our”) is committed to protecting your privacy. This Privacy Policy explains how we collect, hold, use and disclose personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

As a practice of registered migration agents, we are also bound by confidentiality obligations under the Code of Conduct for registered migration agents prescribed by the Migration (Migration Agents Code of Conduct) Regulations 2021 (Cth).

2. Personal information we collect

Depending on the services you seek, we may collect:

  • identity and contact details — name, date of birth, nationality, address, email, phone;
  • passport and travel document details;
  • visa and immigration history, including previous applications, refusals or cancellations;
  • education, qualifications, English test results and employment history;
  • family and relationship details, including details of dependants and partners;
  • financial information relevant to your application or our billing; and
  • information collected through our website, such as enquiry form submissions and technical data (see clause 10).

Sensitive information. Some services require us to collect sensitive information as defined in the Privacy Act, such as health information, criminal record history, or biometric information required by authorities. We collect sensitive information only with your consent, or where the collection is required or authorised by law.

3. How we collect it

We collect personal information directly from you — through our online forms (including forms hosted by our form service provider), by email or phone, in meetings, and from documents you provide. With your consent, we may also collect information from third parties such as your family members or representatives, education providers, assessing authorities and government agencies.

Where you provide us with personal information about another person (for example, a family member included in your application), you must ensure that person is aware of this Privacy Policy and consents to the provision of their information.

4. Why we collect, hold and use it

We collect, hold and use personal information to:

  • provide migration assistance and education consultancy services, including assessing your eligibility and options;
  • prepare and lodge visa, sponsorship, nomination and citizenship applications on your behalf;
  • communicate with the Department of Home Affairs, education providers, skills assessing authorities, state and territory government bodies and other relevant organisations;
  • manage our client relationship with you, including billing and record-keeping;
  • comply with our legal and professional obligations, including record-keeping obligations under the Code of Conduct; and
  • with your consent, send you updates about migration policy changes and our services (you may opt out at any time).

5. Who we disclose it to

We may disclose your personal information to:

  • the Department of Home Affairs and other Australian government agencies, for the purpose of your application;
  • education providers, skills assessing authorities, English language testing bodies, and state or territory nominating bodies, as relevant to your matter;
  • health examination providers and insurers, where required for your application;
  • our service providers who support our business — such as online form processing, cloud hosting, IT support and accounting — under obligations to protect your information; and
  • our professional advisers, or as otherwise required or authorised by law.

We do not sell personal information.

6. Overseas disclosure

We serve clients located outside Australia, including in Taiwan, and communicate with clients and their representatives overseas.

In addition, some of our service providers store or process information on servers located overseas. In particular: our online form provider (Jotform) stores form data in the United States; our accounting software provider (Xero) stores data in the United States and processes data in New Zealand; and our email and cloud service providers may store data in the United States. Accordingly, the countries in which overseas recipients of your personal information are likely to be located include Taiwan, the United States and New Zealand.

Where we disclose personal information to overseas recipients, we take reasonable steps consistent with APP 8 to ensure the recipient handles your information in accordance with the Australian Privacy Principles.

7. Storage and security

We hold personal information in electronic systems protected by access controls, and in physical files stored securely at our office. We take reasonable steps to protect personal information from misuse, interference, loss, and unauthorised access, modification or disclosure. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

8. Retention

We retain client files and records for the period required by law and by our professional obligations, including the record-keeping requirements of the Code of Conduct — generally at least seven (7) years. When personal information is no longer required, we take reasonable steps to destroy or de-identify it.

9. Access and correction

You may request access to the personal information we hold about you, and ask us to correct information that is inaccurate, out of date, incomplete, irrelevant or misleading. Please contact us using the details in clause 12. We will respond within a reasonable period. If we refuse access or correction, we will give you written reasons and information about how to complain.

10. Website, cookies and analytics

Our website uses cookies and similar technologies to make the site easier to use, remember your preferences, and understand how the site is used. You can control or delete cookies through your browser settings; disabling cookies may affect some site features.

Our website forms are provided through a third-party form service. Information you submit through those forms is collected by us and handled in accordance with this Privacy Policy.

11. Complaints

If you have a concern about how we have handled your personal information, please contact us first using the details in clause 12. We will acknowledge your complaint promptly and aim to respond within 30 days.

If you are not satisfied with our response, you may complain to the Office of the Australian Information Commissioner (OAIC): www.oaic.gov.au | 1300 363 992.

Complaints about the professional conduct of a registered migration agent may also be made to the Office of the Migration Agents Registration Authority (OMARA): www.mara.gov.au.

13. Changes to this policy

We may update this Privacy Policy from time to time. The current version will always be available on our website with its effective date. A Traditional Chinese translation is provided for convenience; if there is any inconsistency, the English version prevails.
