1. About these Terms
These Terms and Conditions (“Terms”) govern your access to and use of the website eliteaus.com (the “Site”), operated by Elite AUS Migration Education Consultancy Pty Ltd (ABN 16 626 829 721) (“Elite AUS”, “we”, “us”, “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
These Terms apply to your use of the Site only. They do not govern the provision of migration assistance or education consultancy services, which are provided under a separate written service agreement (see clause 5).
2. Who we are
Elite AUS provides Australian migration and education consultancy services. Our migration agents are registered with the Office of the Migration Agents Registration Authority (OMARA) — Migration Agent Registration Numbers (MARN) 1688242 and 1794749 — and are bound by the Code of Conduct for registered migration agents prescribed by the Migration (Migration Agents Code of Conduct) Regulations 2021 (Cth). Our education counsellors hold Qualified Education Agent Counsellor (QEAC) credentials K110 and Q113.
3. General information only — not migration advice
The content on this Site — including information about visa subclasses, eligibility criteria, points tests, occupation lists, fees, charges and processing times — is provided for general information purposes only. It is not, and must not be relied on as, immigration assistance, legal advice or advice tailored to your individual circumstances.
Australian migration law and policy change frequently and without notice. While we take reasonable care to keep the Site up to date, we do not warrant that any content is current, complete or accurate at the time you read it. You should always confirm current requirements with the Department of Home Affairs (immi.homeaffairs.gov.au) or obtain advice from a registered migration agent about your specific situation.
Your use of the Site, including any enquiry form or interactive tool, does not create an agent–client relationship between you and Elite AUS.
4. No guarantee of outcome
Decisions on visa and citizenship applications are made solely by the Department of Home Affairs and other relevant authorities. Elite AUS does not guarantee, and nothing on this Site should be taken to suggest or imply, the success of any application or a particular outcome, timeframe or decision.
5. Engaging our services
Nothing on this Site constitutes an offer to provide services. If you wish to engage Elite AUS, our services will be provided only under a written service agreement that sets out the scope of services, fees and charges, and your rights and obligations, consistent with the Code of Conduct. Before we commence work, we will also provide you with the consumer information required to be given to clients of registered migration agents.
6. Interactive tools and calculators
The Site may include interactive tools such as a points calculator or eligibility self-assessment. Results generated by these tools are estimates only, based on the information you enter and published settings current at the date shown on the tool. Results are indicative, do not take into account your full circumstances, and are not immigration assistance or advice.
7. Intellectual property
The Site and its original content, features and functionality are owned by Elite AUS and are protected by Australian and international copyright, trade mark and other intellectual property laws. You may view and print content for your personal, non-commercial use. You must not otherwise reproduce, distribute, modify or create derivative works from any content without our prior written consent.
8. Acceptable use
You must not use the Site:
- in any way that breaches any applicable law or regulation;
- to transmit malicious code or interfere with the proper working of the Site;
- to attempt to gain unauthorised access to the Site, its servers or connected systems; or
- to scrape, harvest or systematically extract content or data from the Site without our written consent.
9. Third-party links and embedded services
The Site contains links to third-party websites (including the Department of Home Affairs and OMARA) and may embed services operated by third parties, such as online forms and appointment booking. We do not control and are not responsible for the content, terms or privacy practices of third-party websites and services. Information you submit through an embedded form is also handled in accordance with our Privacy Policy.
10. Disclaimers and limitation of liability
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other statutory right that cannot lawfully be excluded.
Subject to the above, and to the maximum extent permitted by law: (a) the Site is provided on an “as is” and “as available” basis; (b) we exclude all liability for any loss or damage (including indirect or consequential loss) arising from your use of, or reliance on, the Site or its content; and (c) where our liability cannot be excluded but can be limited, our liability is limited, at our option, to the resupply of the relevant services or the cost of resupply.
11. Privacy
Our collection, use and disclosure of personal information is governed by our Privacy Policy, available on the Site. By using the Site you acknowledge that you have read the Privacy Policy.
12. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
13. Governing law
These Terms are governed by the laws of Queensland and the Commonwealth of Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia.
14. Language
A Traditional Chinese translation of these Terms is provided for convenience. If there is any inconsistency between the English version and the Chinese translation, the English version prevails.
